Transitional CbCR Safe Harbour
Educational orientation to the Transitional Country-by-Country Reporting Safe Harbour — three tests, data definitions, and how this concept differs from a commercial calculator page.
What it is (educational framing)
The Transitional CbCR Safe Harbour is a transitional relief framework described in OECD Inclusive Framework Safe Harbours and Penalty Relief materials. In broad terms, it allows groups to use simplified, CbCR-linked tests for a limited transitional period so that qualifying jurisdictions may not require a full GloBE computation for that period.
This Knowledge Center article explains the OECD concept for orientation. It is not the same as Mirentra’s commercial Safe Harbour marketing page (/safe-harbour) or the illustrative calculator tool. Domestic implementing rules and elections control how the framework applies to a specific group.
The three tests (orientation)
De Minimis Test — asks whether qualified CbCR revenue and profit measures both fall below specified thresholds (commonly discussed as under €10 million revenue and under €1 million profit). Both legs use AND logic in the transitional orientation used in Mirentra’s calculator rules pack.
Simplified ETR Test — compares a simplified effective tax rate to a transitional rate that steps from 15% (FY2023–FY2024) to 16% (FY2025) to 17% (FY2026) in Inclusive Framework transitional materials as reflected in Mirentra’s taxConstants.
Routine Profits Test — compares profit before tax to a substance-based amount using Art. 5.3-style carve-out percentages (for example FY2026 payroll 9.4% and tangible assets 7.4%; FY2024 payroll 9.8% and assets 7.8%).
Operationally, a jurisdiction may qualify for transitional relief if any one applicable test is satisfied — but confirm the precise logic, elections, and data definitions under the rules that apply to you.
Data you typically need
Qualified CbCR revenue and profit (or loss), profit before income tax, simplified covered tax components, and substance inputs for eligible payroll and tangible assets are common building blocks. Mapping definitions carefully to guidance is essential — labels in workpapers may not match GloBE or Safe Harbour definitions one-for-one.
Educational article vs product surfaces
Use this page to understand Inclusive Framework concepts and to locate primary OECD PDFs. Use the illustrative Safe Harbour Calculator (/tools/pillar-two-safe-harbour-calculator) only for arithmetic walkthroughs with user-supplied inputs. Use /safe-harbour for commercial product orientation. None of those surfaces is a filing determination or tax advice.
Limits and caution
Transitional relief is time-bounded. A jurisdiction that qualifies in one year may not qualify later. Incomplete or inconsistent inputs should trigger review, not silent pass assumptions. Source-review date for Mirentra’s orientation links: 2026-09-07.
